About Form 15CA 15CB

A clear overview, in simple terms — what it is, why it matters, and how we handle it.

Banks ask for these forms for payments like software and consultancy fees to foreign vendors, royalties, interest, dividends to foreign shareholders, and NRIs moving sale proceeds out of NRO accounts. A wrong DTAA rate or missing TRC can mean the payer bears the tax.

We review the invoice and contract, decide whether the payment is taxable in India and at what rate under the Act or the treaty, collect the TRC and Form 10F, have the certificate issued, and file Form 15CA so your bank can remit.

Quick answer

Before a bank remits a payment to a non-resident, the payer files Form 15CA on the income-tax portal, and for taxable payments above ₹5 lakh in a year a chartered accountant certifies the tax position in Form 15CB. From 1 April 2026 these are Forms 145 and 146 under the Income-tax Act, 2025. Payments on the specified exempt list — such as many imports and personal remittances under LRS — don't need them.

FAQs

Quick answers to common questions.

Search FAQs

What is the difference between Form 15CA and Form 15CB?
Form 15CA is the payer's declaration about a payment to a non-resident, filed online before the bank remits. Form 15CB is a chartered accountant's certificate of the nature of the payment, whether it is taxable in India and the TDS rate under the Act or the treaty. 15CB is needed only for taxable payments above ₹5 lakh in the year.
Which part of Form 15CA should I fill?
Part A for taxable payments up to ₹5 lakh in the financial year; Part B above ₹5 lakh when you have an order or certificate under Section 195(2), 195(3) or 197; Part C above ₹5 lakh with a CA's Form 15CB; and Part D for payments that are not chargeable to tax in India.
When are Form 15CA and 15CB not required?
Neither is needed for payments on the specified list in Rule 37BB — such as payments for imports, and many personal remittances under LRS like travel, education, medical treatment and gifts — or when an individual remits under LRS without RBI approval being needed.
Do NRIs need Form 15CA/15CB to repatriate money from an NRO account?
Yes. NRIs can move up to USD 1 million per financial year from NRO balances, including property sale proceeds, and the bank asks for Form 15CA and a CA's Form 15CB showing the tax on that money has been paid.
What are a TRC and Form 10F used for?
To pay a non-resident at a lower treaty (DTAA) rate, you need the payee's Tax Residency Certificate from their home country and Form 10F filed on the income-tax portal. Without them, TDS has to be deducted at the higher rate under the Act.
What is the penalty for remitting without Form 15CA?
Failing to furnish Form 15CA, or furnishing inaccurate information, can attract a penalty of ₹1 lakh under Section 271-I of the Income-tax Act, 1961, in addition to tax and interest if TDS was short-deducted.
How quickly can 15CA/15CB be done?
Usually the same or next working day once the invoice, contract and TRC are available.

This page also covers

Moving NRI funds abroad up to USD 1 million a year.
