About DTAA Consultation
A clear overview, in simple terms — what it is, why it matters, and how we handle it.
Treaty relief depends on details: the article that applies, beneficial ownership, the principal purpose test introduced through the multilateral instrument, and the right documents at the right time. A credit claimed without Form 67 or a treaty rate applied without a TRC is a common reason for demands.
We read the relevant treaty for your countries and income, confirm the rate or credit, and prepare the documents — for you, your payer in India or your foreign tax adviser.
India has double taxation avoidance agreements (DTAAs) with around 90 countries. A non-resident can apply the treaty rate on Indian income — often 10–15% on interest or dividends instead of 20–30% — by providing a Tax Residency Certificate and Form 10F. Residents taxed abroad on foreign income claim credit in India by filing Form 67 before the return.
| Treaties | Around 90 comprehensive DTAAs |
|---|---|
| Non-residents | Treaty rate needs a TRC and Form 10F |
| Residents | Foreign tax credit via Form 67, filed before the return |
| Anti-abuse | Principal purpose test in many treaties |
| Dual residency | Tie-breaker rules in the residence article |
