About Foreign Income Tax
A clear overview, in simple terms — what it is, why it matters, and how we handle it.
A resident and ordinarily resident individual is taxed in India on worldwide income and must report foreign assets — bank accounts, shares, RSUs, insurance, property — in Schedule FA, on a calendar-year basis, even if no income arose. Tax paid abroad is credited by filing Form 67 before the return. Non-disclosure can attract a ₹10 lakh penalty under the Black Money Act, except for non-property assets totalling up to ₹20 lakh.
Returning NRIs, employees with foreign RSUs and families with overseas accounts are the most common cases. The calendar-year reporting period for Schedule FA, exchange-rate rules and the interaction with foreign returns make this easy to get wrong.
We map every foreign asset and income stream, compute Indian tax with credit for foreign tax, prepare Schedule FA and Form 67, and check whether RNOR status can shelter foreign income for returning NRIs.
| Who | Resident and ordinarily resident individuals |
|---|---|
| Schedule FA | Foreign assets held at any time in the calendar year |
| Credit | Form 67 before the return |
| Black Money Act | ₹10 lakh penalty; relief for non-property assets up to ₹20 lakh (from 1 Oct 2024) |
| RNOR | Foreign income generally not taxed for RNORs |
