About Trademark Objection Reply & Hearing
A clear overview, in simple terms — what it is, why it matters, and how we handle it.
When a trademark application shows 'Objected', the examiner has issued an examination report — usually under Section 9 (the mark is descriptive, generic or lacks distinctiveness) or Section 11 (it conflicts with an earlier mark). You must reply within 30 days of receiving the report, or the application is treated as abandoned. If the reply isn't accepted, a show-cause hearing is scheduled before the application is accepted or refused.
A good reply argues the specific ground: for Section 9, distinctiveness of the mark as a whole and evidence of acquired distinctiveness through use; for Section 11, differences in the marks, the goods, and the trade channels, and coexistence on the register.
Evidence matters: invoices, advertisements and sales figures supported by a user affidavit. We draft the reply, file it online and represent you at the hearing.
| Reply time | 30 days from receipt of the examination report |
|---|---|
| If no reply | Application treated as abandoned |
| Common grounds | Section 9 (absolute) and Section 11 (relative) |
| Next stage | Show-cause hearing if the reply isn't accepted |
