About Expat Tax Services

A clear overview, in simple terms — what it is, why it matters, and how we handle it.

Expat assignments create work on both sides. The employer has to run payroll TDS on the full package — allowances, housing, school fees and any tax it pays for the employee, which is itself taxable and has to be grossed up — and issue Form 16. The employee needs an Indian return that lines up with the home-country return so the same income is not taxed twice.

Residential status drives everything. It is decided each year from days in India (182 days, or 60 days plus 365 days over the previous four years), and a resident is 'not ordinarily resident' if they were non-resident in 9 of the previous 10 years or spent 729 days or less in India in the previous 7. An RNOR is taxed only on Indian income; an ordinarily resident expat is taxed on worldwide income and must report foreign assets in Schedule FA.

We handle the whole cycle: residency and treaty analysis before arrival, PAN and payroll set-up, split-payroll and shadow-payroll TDS, PF for international workers or the certificate of coverage that exempts them, returns with foreign tax credit (Form 67), and the departure year — final return and the employer undertaking needed before leaving India.

FY 2025-26 (AY 2026-27) is governed by the Income-tax Act, 1961. From tax year 2026-27 the Income-tax Act, 2025 applies; section and form numbers change, but the residency, treaty and payroll rules work the same way.

Quick answer

A foreign national working in India is taxed on salary for work done here, wherever it is paid. Residents are taxed on worldwide income, but most new arrivals are 'resident but not ordinarily resident' (RNOR) for about their first two years, so foreign income stays outside Indian tax. Short assignments can be exempt under Section 10(6)(vi) or a tax treaty, and international workers join the Indian PF unless an SSA certificate covers them.

FAQs

Quick answers to common questions.

Search FAQs

Is a foreign national's salary taxable in India?
Yes, salary for work done in India is taxable here even if it is paid abroad or into a home-country account. Foreign-paid salary is usually covered through a shadow payroll in India so TDS can be deducted; otherwise the expat pays advance tax.
What is RNOR status for expats?
A resident is 'not ordinarily resident' if they were non-resident in 9 of the previous 10 years, or spent 729 days or less in India in the previous 7 years. Most expats qualify for about their first two years, so only Indian income and income from a business controlled in India is taxed.
Is there an exemption for short business trips to India?
Under Section 10(6)(vi), pay is exempt if the stay is 90 days or less in the year, the foreign employer has no business in India and the cost is not charged to an Indian entity. Most tax treaties extend this to 183 days under Article 15, subject to similar conditions.
Does a foreign employee need to pay Indian PF?
Generally yes. An 'international worker' contributes on full salary from day one, unless they hold a certificate of coverage under a social security agreement. India has these agreements with countries including Germany, France, Japan, the Netherlands, Switzerland, Canada, Australia and South Korea.
Do expats need to register with the FRRO?
Foreign nationals on employment, project or other long-term visas valid for more than 180 days must register with the FRRO within 14 days of arrival, online through the e-FRRO portal. Some visas carry an endorsement requiring registration even for shorter stays.
What is tax equalisation?
Under tax equalisation the employee pays only the tax they would have paid at home (a 'hypothetical tax') and the employer bears the Indian tax. The tax the employer pays is itself taxable salary, so payroll must gross it up — a common source of under-deducted TDS.
Do expats have to report foreign bank accounts in their Indian return?
Only when they are resident and ordinarily resident. They then report foreign accounts, shares, property and other assets in Schedule FA. Non-disclosure can attract a ₹10 lakh penalty under the Black Money Act; since 1 October 2024 there is no penalty where foreign assets other than immovable property total ₹20 lakh or less.
How do expats avoid double taxation?
Tax paid abroad on income also taxed in India is claimed as foreign tax credit under the treaty, by filing Form 67 by the end of the assessment year along with a return filed on time or as a belated return.
What tax steps are needed before an expat leaves India?
File the departure-year return and settle any tax due. Under Section 230 of the 1961 Act, a foreign national who came for employment gives an undertaking from the employer (Form 30A) that tax will be paid, so a no-objection certificate can be issued where required.
