About NRI Property Sale Compliance
A clear overview, in simple terms — what it is, why it matters, and how we handle it.
When an NRI sells property in India, the buyer must deduct TDS on the capital gain — 12.5% plus surcharge and cess for long-term gains — and without a lower-deduction certificate, banks and buyers often deduct on the full sale price. NRIs can apply for that certificate (Form 13, now Form 128 under the 2025 Act) before the sale. Sale proceeds can then be repatriated up to USD 1 million a year with Forms 15CA and 15CB.
The biggest cost is timing: TDS deducted on the whole sale value can lock up a large amount until the refund is processed. Applying for a lower-deduction certificate before the registration date solves this.
We compute the actual gain, apply exemptions (reinvestment under Sections 54/54F or bonds under 54EC), obtain the certificate, guide the buyer on TAN and TDS filing, file your return, and handle repatriation paperwork.
| LTCG rate | 12.5% without indexation after 24 months (plus surcharge and cess) |
|---|---|
| Buyer's TDS | On the gain; on the full price without a certificate |
| Lower-deduction certificate | Form 13 (Form 128 from 1 April 2026) |
| Buyer needs | A TAN and a quarterly non-resident TDS statement |
| Repatriation | Up to USD 1 million per financial year from NRO |
