About Gift Tax Advisory

A clear overview, in simple terms — what it is, why it matters, and how we handle it.

Quick answer

India has no separate gift tax, but gifts are taxed as income of the person receiving them if they exceed ₹50,000 in a year from non-relatives. Gifts from relatives (as defined), on marriage, by will or inheritance are exempt. Income earned on assets gifted to a spouse or minor child is clubbed with the giver's income, and gifts from residents to NRIs are treated as Indian income unless an exemption applies.

Family gifts are common and mostly tax-free, but the details matter: who counts as a relative, how clubbing works when you gift to a spouse, what stamp duty a property gift deed attracts, and how gifts to children abroad are treated.

We review the planned gift, the relationship and the asset, recommend the right documentation (gift deed, bank trail), and explain the tax for both sides — including later income and capital gains.
