# Trademark Objection Reply & Hearing

> When a trademark application shows 'Objected', the examiner has issued an examination report — usually under Section 9 (the mark is descriptive, generic or lacks distinctiveness) or Section 11 (it conflicts with an earlier mark). You must reply within 30 days of receiving the report, or the application is treated as abandoned. If the reply isn't accepted, a show-cause hearing is scheduled before the application is accepted or refused.

A good reply argues the specific ground: for Section 9, distinctiveness of the mark as a whole and evidence of acquired distinctiveness through use; for Section 11, differences in the marks, the goods, and the trade channels, and coexistence on the register.

Evidence matters: invoices, advertisements and sales figures supported by a user affidavit. We draft the reply, file it online and represent you at the hearing.

## FAQs

### What happens if I don't reply to a trademark objection?

The application is treated as abandoned and you would have to file afresh.

### Can I still use my brand while the objection is pending?

Yes, but you can't use the ® symbol until registration; use ™ instead.

### How do I overcome a Section 11 objection?

By showing the marks, goods or customers are different enough to avoid confusion, coexistence with the cited marks, or honest concurrent use, supported by evidence.
