# Tax on Jointly Owned Property

> Each co-owner is taxed on their own share of rent and capital gains, in the ratio of their ownership — usually as stated in the sale deed. Co-owners who are also co-borrowers can each claim home-loan interest and principal deductions on their share. Each co-owner can claim Section 54 on their share of the gain. But if one spouse paid for the other's share, the clubbing rules can bring that income back to the payer.

Problems arise when the deed doesn't state shares, or when shares don't match who actually paid. We reconcile ownership shares with payment records before filing, so returns of all co-owners agree.

On sale, the ₹50 lakh threshold for 1% TDS applies to the total consideration, so even small individual shares can attract TDS when the whole property crosses the limit.
