# F&O Trading Tax & ITR-3 Filing

> Futures and options trading on recognised exchanges is non-speculative business income, reported in ITR-3 and taxed at slab rates. You can deduct brokerage, internet, advisory subscriptions, interest on borrowings and depreciation on equipment. F&O losses can be set off against any income except salary and carried forward for eight years if you file on time. Tax audit depends on your turnover, which is the sum of absolute profits and losses on each trade — not the contract value.

Most F&O traders with losses still need to file — on time — to carry the loss forward. Filing ITR-2 by mistake, or missing the due date, is how traders lose years of carried-forward losses.

We pull your broker's tax P&L, compute turnover as per the ICAI Guidance Note, check tax audit applicability, claim legitimate expenses, and file ITR-3 with balance sheet and P&L in the format the portal expects.

## FAQs

### Can F&O losses be set off against salary?

No. Business losses can't be set off against salary income. They can be set off against other heads such as capital gains, rent or interest in the same year, and the rest is carried forward.

### How is F&O turnover calculated?

Per the ICAI Guidance Note, turnover is the total of favourable and unfavourable differences — the absolute value of profit or loss on each squared-off trade. Premium received on selling options is no longer added separately.

### Do I need a tax audit for F&O losses?

Only if turnover exceeds the audit limit (₹10 crore when transactions are digital), or if you had opted for presumptive taxation in an earlier year and now declare lower profit while your total income exceeds the basic exemption limit.
