# Tax on Side Income for Salaried Employees

> Side income from freelancing, consulting or content creation is business or professional income, added to your salary and taxed at slab rates. You can use presumptive taxation under Section 44ADA (50% of receipts as income) if eligible and file ITR-4, or keep accounts and file ITR-3. Pay advance tax on it, since your employer's TDS doesn't cover it, and register for GST once receipts cross ₹20 lakh.

Practice: Salary, RSU & ESOP Tax — https://www.industax.com/services/employee-tax/

The tax department sees platform payouts, TDS by clients and foreign remittances in your AIS, so undeclared side income is easy to detect. Declaring it properly is usually cheap, especially under 44ADA.

Check your employment contract too — some employers restrict outside work, which is an employment question separate from tax.

## FAQs

### Can I file ITR-1 if I have freelance income?

No. ITR-1 doesn't allow business or professional income. Use ITR-4 under presumptive taxation or ITR-3 otherwise.

### Can I claim expenses against side income?

Yes, under ITR-3 you can deduct actual expenses with records. Under 44ADA, expenses are assumed at 50% and not separately claimed.

### Does foreign side income need GST?

Export of services counts towards the ₹20 lakh threshold. Above it, register and export under LUT without paying IGST.
